An important step was made this week at the Brazilian Consulate in Montreal to foster exchanges with regards to international commercial dispute resolution mechanisms.

Dan Kraft presented the similarities and differences between mediation in Québec and in Brazil, due to recent changes in their Civil Procedure Codes.

The Hon. Louise Otis participated as speaker, along with the Vice-President of the Arbitration and Mediation Center of the Brazil Canada Chamber of Commerce (CAM-CCBC), Mr. Carlos Forbes, and the Brazilian author and arbitrator Carlos Alberto Carmona. The president of CCBC Paulo Perroti and the Brazilian Counsel Rubens Gama hosted  the participants indicating their intention to inform the business community on available professionals and techniques capable of assisting companies in both countries to structure deals and solve disputes.

Dan Kraft briefly explained about the legislative process of mediation in Brazil and in Québec. He also indicated that Canada signed, along with China and the US, the 2019 Mediation Singapore Convention expecting that Brazil will soon join nations that give effect to international mediation agreements in their territories.

Dan Kraft is an accredited mediator (IMAQ) experienced in Brazilian and international businesses, notably on mining, infrastructure and finance. As a mediator and arbitrator  Dan is part of arbitrators’ lists in prestigious Brazilian centers.

Hon. Louise Otis gave an excellent speech on the importance of resorting to Med-Arb in large projects, giving an example of a recent conflict where both institutes were used to defuse a standoff situation, enabling a large contract to continue after 2 months of dispute only.

As a final note we inform that our partner Dr. David Carvalho was awarded a PhD title by the Universidade de São Paulo – USP. His thesis is about international commercial mediation and will soon be published as a book.
